Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of okfractionalcmo.com (the "Site") and your engagement with Trevano ("we," "us," or "our") for fractional chief marketing officer services, strategy consultations, and related marketing advisory services (collectively, the "Services").

By accessing the Site, submitting a form, booking a call, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Site or Services.

Services and Nature of Relationship

The Site describes marketing leadership and advisory services. Any engagement for paid Services is subject to a separate agreement (for example, a statement of work or contract) that sets scope, fees, and deliverables. If there is a conflict between these Terms and a signed written agreement for Services, the signed agreement controls for that engagement.

Nothing on the Site guarantees specific business or marketing results. Outcomes depend on many factors outside our control.

Not Legal, Tax, or Financial Advice

Our Services focus on marketing strategy and leadership. We do not provide legal, tax, accounting, or investment advice. You should consult qualified professionals for those matters.

Intellectual Property

The Site and its content (including text, graphics, logos, layout, and branding) are owned by Trevano or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from the Site or its content without our prior written permission, except as allowed by limited personal, non-commercial viewing or as required for normal browser caching.

Materials you provide to us remain yours, but you grant us a non-exclusive license to use them as reasonably necessary to provide the Services.

Acceptable Use

You agree not to:

  • Use the Site or Services in any unlawful way or in violation of these Terms.
  • Attempt to gain unauthorized access to our systems, accounts, or data.
  • Transmit malware, spam, or harmful code.
  • Scrape, harvest, or automate access to the Site in a way that impairs performance or bypasses normal use.
  • Misrepresent your identity or affiliation.

Disclaimer of Warranties

The Site and any information on it are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

Limitation of Liability

To the fullest extent permitted by law, Trevano and our owners, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Site or Services, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Site or these Terms (except where limited by applicable law) will not exceed the greater of (a) the amount you paid us for Services in the twelve (12) months before the claim or (b) one hundred U.S. dollars (USD $100).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Trevano and our representatives from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site or Services, your violation of these Terms, or your violation of any third-party rights.

Governing Law and Venue

These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law rules. For disputes not subject to mandatory arbitration or small-claims procedures, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Oklahoma County, Oklahoma, except where prohibited by law.

General

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms constitute the entire agreement between you and Trevano regarding the Site and supersede prior discussions, except where a separate Services agreement applies.

Changes to These Terms

We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Your continued use of the Site after the effective date of changes constitutes acceptance of the revised Terms, to the extent permitted by law.
